1. Tanımlar
Platform: ARGUS AI siber güvenlik test ve yönetim platformu
Das Smart: Das Smart Teknoloji ve Ticaret A.Ş.
Kullanıcı: Platforma kayıtlı gerçek veya tüzel kişi
Hizmet: Platform üzerinden sunulan tüm güvenlik testi, tarama, raporlama ve yönetim araçları
Hedef: Güvenlik testine tabi tutulan sistem, ağ veya uygulama
2. Kabul ve Kapsam
ARGUS AI platformuna erişerek veya platformu kullanarak, bu Kullanım Şartları'nı, Gizlilik Politikası'nı ve KVKK Aydınlatma Metni'ni okuduğunuzu, anladığınızı ve kayıtsız şartsız kabul ettiğinizi beyan etmiş olursunuz. Bu şartları kabul etmiyorsanız platformu kullanmayınız.
3. Hesap ve Güvenlik
Platforma kayıt olurken doğru, güncel ve eksiksiz bilgi vermekle yükümlüsünüz.
Hesap bilgilerinizin (kullanıcı adı, şifre) gizliliğinden yalnızca siz sorumlusunuz.
Hesabınızın yetkisiz kullanımını tespit ettiğinizde derhal Das Smart'a bildirim yapmalısınız.
18 yaşından küçük kişiler platformu kullanamaz.
Das Smart, şüpheli hesap aktivitelerinde hesabı askıya alma hakkını saklı tutar.
4. Hizmet Kullanım Koşulları
4.1. Yetkili Kullanım Zorunluluğu
ARGUS AI platformunda bulunan tüm güvenlik test araçları yalnızca yetkili olduğunuz sistemler üzerinde kullanılabilir. Hedef sistem üzerinde güvenlik testi yapmak için yazılı izin almış olmanız zorunludur. Yetkisiz testler, Türk Ceza Kanunu (TCK m.243, m.244), 5651 sayılı Kanun ve ilgili Bilişim Suçları mevzuatı kapsamında suç teşkil eder.
4.2. Kabul Edilemez Kullanım
Aşağıdaki kullanımlar kesinlikle yasaktır:
Yetkisiz sistemlere erişim veya erişim teşebbüsü
Kötü amaçlı yazılım geliştirme veya dağıtımı
Hizmet kesintisi (DoS/DDoS) saldırıları
Platformun kopyalanması, tersine mühendislik yapılması
Platform API'lerinin kötüye kullanımı
Yasa dışı faaliyetlerin planlanması veya icrası
4.3. Fikri Mülkiyet
ARGUS AI platformu, tüm kod, tasarım, logo, metin ve grafik unsurlarıyla Das Smart Teknoloji'nin fikri mülkiyetidir. 5846 sayılı Fikir ve Sanat Eserleri Kanunu ve ilgili mevzuatla korunmaktadır.
5. Hizmet Seviyesi ve Sınırlamalar
Das Smart, platformun sürekli erişilebilirliği için makul çabayı gösterir ancak %100 kesintisiz hizmet taahhüt etmez.
Planlı bakım çalışmaları önceden duyurulur.
Mücbir sebep hallerinde (doğal afet, siber saldırı, altyapı kesintisi) hizmet aksayabilir.
Ücretsiz plan kullanıcıları için hizmet seviyesi taahhüdü bulunmamaktadır.
6. Ücretlendirme ve Faturalandırma
Hizmet ücretleri, seçilen plana göre portalda belirtilen fiyatlar üzerinden tahsil edilir.
Ödemeler IYZICO güvenli ödeme altyapısı üzerinden gerçekleştirilir.
Faturalar elektronik ortamda (e-fatura) düzenlenir ve e-posta ile gönderilir.
Abonelikler, kullanıcı tarafından iptal edilmediği sürece otomatik yenilenir.
İptal talepleri bir sonraki fatura döneminde geçerli olur; cari dönem iadesi yapılmaz.
7. Sorumluluğun Sınırlandırılması
Das Smart Teknoloji, ARGUS AI platformunun kullanımından doğabilecek doğrudan veya dolaylı hiçbir zarardan sorumlu tutulamaz. Kullanıcı, platformu kullanarak tüm riski üstlenmiş sayılır.
8. Sözleşmenin Feshi
Das Smart, aşağıdaki hallerde kullanıcı hesabını derhal sonlandırma hakkına sahiptir:
Kullanım Şartları'nın ihlali
Yetkisiz güvenlik testi yapılması
Yasa dışı faaliyet tespiti
Ödeme yükümlülüklerinin yerine getirilmemesi
9. Uyuşmazlık Çözümü
Bu Kullanım Şartları, Türkiye Cumhuriyeti kanunlarına tabidir. Uyuşmazlıklarda İzmir Mahkemeleri ve İcra Daireleri yetkilidir. Ticari uyuşmazlıklarda, dava açılmadan önce arabuluculuğa başvurulması zorunludur (TTK m.5/A).
10. Değişiklikler
Das Smart, Kullanım Şartları'nda değişiklik yapma hakkını saklı tutar. Değişiklikler yayınlandığı tarihte yürürlüğe girer. Platformu kullanmaya devam etmeniz, değişiklikleri kabul ettiğiniz anlamına gelir.

1. Definitions
Platform: The ARGUS AI cybersecurity testing and management platform
Das Smart: Das Smart Teknoloji ve Ticaret A.Ş.
User: Any natural or legal person registered on the Platform
Service: All security testing, scanning, reporting, and management tools offered through the Platform
Target: Any system, network, or application subjected to security testing
2. Acceptance and Scope
By accessing or using the ARGUS AI platform, you declare that you have read, understood, and unconditionally accepted these Terms of Use, the Privacy Policy, and the KVKK Disclosure Text. If you do not accept these terms, do not use the platform.
3. Account and Security
You are obligated to provide accurate, current, and complete information when registering on the Platform.
You are solely responsible for the confidentiality of your account credentials (username and password).
You must immediately notify Das Smart upon detecting any unauthorized use of your account.
Persons under the age of 18 may not use the platform.
Das Smart reserves the right to suspend accounts in the event of suspicious activity.
4. Service Terms of Use
4.1. Authorized Use Requirement
All security testing tools available on the ARGUS AI platform may be used only on systems you are authorized to test. You must obtain written authorization before conducting security testing on any target system. Unauthorized testing constitutes a criminal offense under the Turkish Penal Code (TCC Art. 243, 244), Law No. 5651, and relevant cybercrime legislation.
4.2. Prohibited Uses
The following uses are strictly prohibited:
Unauthorized access or attempted access to systems
Development or distribution of malicious software
Denial-of-service (DoS/DDoS) attacks
Copying or reverse engineering the Platform
Misuse of Platform APIs
Planning or carrying out illegal activities
4.3. Intellectual Property
The ARGUS AI platform, including all code, design, logos, text, and graphical elements, is the intellectual property of Das Smart Teknoloji and is protected under Law No. 5846 on Intellectual and Artistic Works and applicable legislation.
5. Service Level and Limitations
Das Smart undertakes reasonable efforts to ensure continuous platform availability but does not guarantee 100% uninterrupted service.
Planned maintenance will be announced in advance.
Service may be disrupted due to force majeure events (natural disasters, cyberattacks, infrastructure failures).
No service level commitment is provided for free plan users.
6. Pricing and Billing
Service fees are charged according to the prices stated on the portal for the selected plan.
Payments are processed through the IYZICO secure payment infrastructure.
Invoices are issued electronically (e-invoice) and sent via email.
Subscriptions auto-renew unless cancelled by the user.
Cancellation requests take effect from the next billing period; no refunds are made for the current period.
7. Limitation of Liability
Das Smart Teknoloji shall not be held liable for any direct or indirect damages arising from the use of the ARGUS AI platform. By using the platform, the user assumes all risk.
8. Termination
Das Smart has the right to terminate a user's account immediately in the following circumstances:
Violation of these Terms of Use
Conducting unauthorized security tests
Detection of illegal activity
Failure to fulfill payment obligations
9. Dispute Resolution
These Terms of Use are governed by the laws of the Republic of Turkey. İzmir Courts and Enforcement Offices have jurisdiction over disputes. For commercial disputes, mediation must be sought before filing a lawsuit (TCC Art. 5/A).
10. Amendments
Das Smart reserves the right to amend these Terms of Use. Amendments take effect on the date of publication. Your continued use of the Platform constitutes acceptance of such amendments.
